Liability Waiver & Safety Notice

PLEASE READ CAREFULLY. PARTICIPATION INVOLVES RISKS OF SERIOUS INJURY OR DEATH, AND THIS NOTICE DESCRIBES A RELEASE OF CLAIMS, INCLUDING CLAIMS FOR ORDINARY NEGLIGENCE.

1. Voluntary Participation

CityCentre Running Club (CCRC) organizes informal group runs, walks, and related social activities in and around Houston, Texas. Participation is entirely voluntary. Each participant chooses whether to attend, what distance and pace to attempt, and whether to continue or stop. CCRC does not provide medical supervision, guarantee any route or gathering is safe, or guarantee the conduct of other participants or members of the public.

2. Risks of Participation

Running, walking, and group activities may involve hazards including uneven pavement, potholes, curbs, slips, falls, collisions, motor vehicles, bicycles, pedestrians, darkness, poor visibility, heat, humidity, severe weather, dehydration, overexertion, medical emergencies, and actions or omissions of others. These risks can result in property loss, illness, bodily injury, permanent disability, or death. Conditions may change without warning.

3. Assumption of Risk

Each participant knowingly and voluntarily accepts the inherent and reasonably foreseeable risks of taking part, whether known or unknown, including risks associated with the ordinary negligence of the Released Parties defined below, to the extent permitted by Texas law. Participants are responsible for their own health and fitness decisions, hydration, equipment, attention to surroundings, and compliance with applicable traffic laws.

4. EXPRESS RELEASE OF LIABILITY, INCLUDING ORDINARY NEGLIGENCE

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, THE PARTICIPANT RELEASES, WAIVES, AND DISCHARGES CITYCENTRE RUNNING CLUB (CCRC), ITS ORGANIZERS, OFFICERS, DIRECTORS, MEMBERS, RUN LEADERS, VOLUNTEERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM CLAIMS, DEMANDS, DAMAGES, AND CAUSES OF ACTION FOR PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, DISABILITY, OR DEATH ARISING OUT OF OR RELATED TO PARTICIPATION IN CCRC ACTIVITIES, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

This release is intended to address ordinary negligence expressly. It does not seek to waive liability for gross negligence, reckless or intentional misconduct, or any claim that cannot lawfully be released.

5. Personal Responsibility and Safety

Participants must obey traffic signals and laws, use sidewalks or designated routes when appropriate, remain aware of vehicles and other hazards, and follow reasonable safety directions. Each participant is responsible for deciding whether they are physically able to participate and should stop if they feel unwell or unsafe. Participants remain responsible for their own medical care and associated expenses. Nothing in this notice creates a duty to provide medical services.

7. Third-Party Locations and Activities

Routes, parking areas, sidewalks, roadways, businesses, and post-run gathering locations may be operated or controlled by third parties. CCRC does not control their conditions, policies, or personnel. Participants are responsible for complying with applicable rules and exercising care at these locations.

8. Texas Law and Severability

This notice is intended to be interpreted under the laws of the State of Texas. If any provision is held unenforceable, the remaining provisions should remain effective to the extent permitted by law.

PARTICIPATION IS A PERSONAL CHOICE. PLEASE READ THIS NOTICE AND ANY SEPARATE AGREEMENT PRESENTED AT EVENT CHECK-IN BEFORE JOINING A CCRC ACTIVITY.
